Protecting Intellectual Property Policy

ProStores is committed to protecting the intellectual property rights of third parties. ProStores' IP Program was developed to facilitate cooperation between ProStores and rights owners ("Rights Owners") protecting their intellectual property rights.

Intellectual Property Program

Highlights of the program include:

  • Temporary suspension and/or termination of stores using ProStores' services which are the subject of a NOCI (defined below).
  • Termination of repeat offenders
  • Continuing efforts to identify and prevent previously suspended merchants from reregistering for ProStores network servers
  • Cooperation with rights owners seeking personal information on alleged infringers.

However, because ProStores is not an expert in the intellectual property rights of all Rights Owners, and cannot verify that a merchant has the right to sell the items or services offered for sale using the ProStores services, ProStores requests that Rights Owners help identify cases of potential infringement.

How To Report an Infringing Merchant

Step One:

If you have a good faith belief that a merchant's goods or services offered via a merchant's store infringes your copyright, trademark, or other intellectual property rights, all you need to do is download the Notice of Claimed Infringement (NOCI) form, fill it out, and fax it to ProStores at 408 516-8811. Download ProStores' NOCI form.

You will need Adobe® Acrobat Reader to view and print the NOCI form. If you do not have Adobe® Acrobat Reader, you can download a free copy at Adobe's Web site.

Step Two:

Following receipt of the first NOCI, ProStores will send you an electronic version of the NOCI form so that you may send future notices to ProStores via email.

ProStores will contact you using the information in the NOCI form in order to investigate the claimed infringement in accordance with ProStores' internal processes designed to meet the requirements of the Digital Millennium Copyright Act.
