e-Gift Card Policy

ProStores, Inc. ("ProStores") maintains this e-Gift Card Policy ("GC Policy") to provide merchants using the e-Gift Card product functionality ("Merchant(s)") with information relating to Merchant's use of the e-Gift Card product.

ProStores may amend this GC Policy at any time by posting the amended GC Policy on the ProStores Website. All amended terms shall automatically be effective 30 days after they are initially posted on the ProStores Website. Merchant's continued use of e-Gift Card product will constitute Merchant's acceptance of any changes or additions to this GC Policy.

e-Gift Card Product Description

This policy governs the e-Gift Card product and by offering e-Gift Cards, Merchant agrees to be bound by these terms and conditions.

e-Gift Cards is a product that allows Merchants to offer e-Gift Cards for sale through the Merchant's ProStores hosted website. Purchasers may purchase an e-Gift Card for a designated recipient, who may then redeem that e-Gift Card only on purchases made on the Merchant’s ProStores hosted website. The purchaser must define the recipient at the time of purchase for e-Gift Cards which are delivered only by e-mail. Once purchased, e-Gift Cards delivered by e-mail may not be transferred to a different recipient.

Merchant acknowledges and agrees that Merchant is the issuer and manager of the e-Gift Card and that ProStores merely provides certain product functionality. Merchant is bound by the e-Gift Card Terms and Conditions included in the e-Gift Card and shall not amend or revise such e-Gift Card Terms and Conditions in any way, except as required to comply with applicable law. Merchant releases ProStores from any and all claims arising in connection with Merchant's e-Gift Cards.>

Purchase and redemption of e-Gift Cards may be subject to the Merchant's website user agreement and privacy policy, where these have been adopted by Merchant (including without limitation Merchant's policies on returning and exchanging merchandise); provided however that Merchant shall not adopt terms and conditions that conflict with its obligations under this GC Policy or applicable law.

Sale & Redemption of e-Gift Cards

Proceeds from the sale of e-Gift Cards are stored by and the responsibility of the Merchant. Merchant must comply with all applicable Federal, state and local laws regarding the handling and management of funds related to any e-Gift Card.

Since e-Gift Cards do not expire, a recipient will always be able to redeem the unused value associated with a valid e-Gift Card. Merchant acknowledges that it has responsibility to comply with all applicable laws in connection with unused e-Gift Card balances.

e-Gift Card redemptions are limited to a total of $500, per person, per purchase. Further, no more than a total of $500, per person, per month, in e-Gift Cards may be purchased for use on a Merchant's website.

Cancellation/Non-Expiration of e-Gift Cards

A Merchant may cancel any unredeemed e-Gift Card at any time provided Merchant refunds the full value of the e-Gift Card (or the remaining balance if partially redeemed) to the purchaser and notifies the purchaser and, if different, the recipient of such cancellation.

e-Gift Cards do not expire. Any unused value associated with an e-Gift Card will remain available to the recipient until spent and Merchant shall honor valid e-Gift Card until the value associated with such e-Gift Card is zero.

Account closure: If Merchant's ProStores account is closed, by Merchant or otherwise in accordance with the terms of the User Agreement, then the Merchant shall remain fully liable for e-Gift Card balances and compliance with applicable law.

Fees

Merchant shall not charge fees in connection with e-Gift Cards, including in connection with their purchase, maintenance and redemption.

ProStores charges Merchant its standard transaction fees when an e-Gift Card is purchased; however, ProStores will not subsequently charge Merchant any additional fees on payment amounts from e-Gift Cards. For split payments where e-Gift Card balances are insufficient to cover the entire purchase, standard transaction fees will apply only to other payment methods used.

Merchant will provide the full face value stated on the purchased e-Gift Card.

Customer Service

Merchant shall provide support for the purchasers and recipients of e-Gift Cards.

e-Gift Card Terms and Conditions

These terms and conditions are between you, the recipient of the e-Gift Card, and the merchant that issues and redeems this e-Gift Card ("Merchant"). By accepting and using this e-Gift Card, you agree to be bound by these terms and conditions.

Redeeming e-Gift Cards
  • Your e-Gift Card can be used solely to pay for items sold on Merchant's website.
  • You cannot redeem this e-Gift Card at any other merchant or for cash (unless otherwise required by law).
  • This e-Gift Card is only redeemable at the merchant's website; not a physical store.
  • Any unused value will remain on your e-Gift Card until spent (unless otherwise required by law).
  • If e-Gift Card balance is insufficient to cover the entire purchase including applicable tax and shipping / handling, the remaining balance must be paid using other available payment methods.
  • e-Gift Card redemptions are limited to a total of $500, per person, per purchase.
  • For security purposes, you may be required to register as a user of the Merchant’s website.
Cancellation / Non-Expiration of e-Gift Cards / No Fees
  • No fees will be charged in connection with your e-Gift Card.
  • Merchant Cancellations: e-Gift Card are issued by the Merchant indicated. The Merchant may cancel an e-Gift Card at any time for any reason and shall refund any unused e-Gift Card value to purchaser, provided the e-Gift Card has not been redeemed.
  • Expiration: Merchant e-Gift Cards do not expire and no fees apply.
Additional Terms
  • Your e-Gift Card is non-transferable and its resale is prohibited.
  • Your e-Gift Card cannot be redeemed for cash and has no cash value (unless otherwise required by law).
  • Merchant is not responsible for lost, stolen, or misused e-Gift Card codes (unless otherwise required by law).
  • Purchase and redemption of e-Gift Card is subject to the Merchant's website user agreement and privacy policy which are incorporated herein, including without limitation Merchant’s policies on returning and exchanging merchandise.
